CM Punk and Festus are the #1 contenders. That means they have the FIRST (or next) shot at the titles. Legacy don't have such a distinction, therefore they don't have the right to challenge for the titles. Plus, if Legacy won, then Punk and Festus would have a new team to prepare for (in kayfabe terms), so no title match.
