No one's really certain about this, and we've been debating this back and forth on these forums for a while now. I'm a firm believer that whether he returns tonight or not, I believe that he legally would be able to.

Why not? What would happen, WWE would sue themselves for breach of contract? I believe the 90 day clause applies to him not jumping ship to the competition, but in no way prevents him to returning to the company that "fired" him in the first place.

Show and SES have had a good fued but I have low expectations for the match, especially if Punk is still slightly injured which I suspect he is otherwise why would this be a handicap match.
