Who owns the rights to Real American?

What's the craic?
Since Hulk Hogan joined TNA there has been two of his old themes used, both from his time in WCW. He has consistently used the nWo theme and he bequeathed the 'American Made' one to Abyss during the ill fated HoF ring storyline. Now, WWe has used 'American Made' on a number of occasions right up to last night when they used it to promote the release of 'No Holds Barred'...

For a long time I made the assumption that this was because the WWe had maintained the rights, as they do with the majority of their entrance themes, but then I spotted this...

So what is the story? Have they joint rights? Biggest question of all, why the hell isn't Hulk using this (can you imagine the pop this would have created at Slammiversary)?
 
I'm pretty sure WWE owns it but not 100% sure. Doesn't matter though, owning the song doesn't mean no one else can use it. It means no one else can use it without permission. TNA could have paid to use it.
 
I'd thought of that but given the strained relationship between the two companies, it strikes me as strange that this would happen.
 
Spike was probably the one's who asked. They've used the Hardy Boyz theme before and I remember a Disney commercial with it too. And other WWE themes have been used outside as well. TNA Impact's theme from 2006 was used to cover over Limp Bizkits's "My Way" on Wrestlemania X-Seven too.
 
Either I am deaf or I did not hear American Made, which I believe Hogan himself owns the rights to, in the No Holds Barred trailer; rather it was Real American which WWE own.

My mistake, I meant Real American (I was trying to illustrate that it was being used to advertise the products of both companies). Apologies.:blush:
 
I would have thought Hulk Hogan would have been copyrighted and protected by the WWE to the max, including the theme. I remember reading through a load of wrestler signed to WWE and Hogan was the only one who's name had TM after it. You'd have to assume if Hogan had the theme, he'd have used it - it's better than the one he goes with now.

But even without that; isn't the song just part of the trailer? If so, it's not going to cause any issues playing it regardless of who the song belonged to I wouldn't have thought?
 
This is just a case of mistaken identity. You guys are assuming that TNA is using the (one would assume) WWE owned song Real American that Hulk Hogan used for decades as entrance music. They aren't. They are using the Rick Derringer song "Real American". Same song, same performer, but the version they used had a longer intro (see the first 10 seconds, which are not in the WWE version). That difference (along with maybe a couple different very minor differences that are not noticable) probably is what allows Derringer to hold the rights to that version, as supposed to WWE.

TNA doesn't use it all the time for Hogan because they probably don't want to pay for it, or they don't want to make people think of WWE.
