High School, College, & Pro Sports: Are Athletes Above The Law?

What really got me thinking about this topic, is the ongoing scandal surrounding Florida State Seminals QB, former Heisman Trophy Winner, Jameis Winston. Jameis Winston has been accused of raping a women, bringing a BB gun on campus, stealing food and drinks from fast-food joints, and accepting payment in exchange for autographs. The hilarious thing about all of this? Jameis Winston is playing against the Notre Dame Fighting Irish tomorrow. A man accused of not only shoplifting and taking illegal money, but also of RAPE has not even been suspended by the school while they look into the cases. Furthering my argument, there have been numerous allegations that both the police and the school have been desperately trying to cover up the rape allegation, and some reports say that the woman who is accusing Winston of rape, is being intimidated into silence by none other than the police... Now I'm not saying I believe all this, but isn't it time we say, not everything is about football?

There are numerous stories in the news like the one above. I once remember an entire town protesting the imprisonment of two high school football players who were charged with the rapes of two 15 year old girls. Another story sees freshmen hazed by being sexually assaulted by their teammates. Is this what the world has come to? Because somebody can run fast and jump high, they should be allowed to get away with rape and murder?

What furthered my anger, was watching a sports broadcast where the two broadcasters say that Winston plays a lot better when there is "controversy and all eyes on him". Really. You're going to talk about how this guy plays better because of the rape allegations? Does nobody care that this guy most likely sexually assaulted somebody and all the world wants to focus on is his game on Saturday? No wonder sports athletes act like they can do whatever the hell they want? Because imo, a lot of them can.

Do you agree with me? Are athletes above the law?
 
No, actually. I don't agree with you. I'm going to first quote just a few sentences from your post, and bold certain words in each post just to see if they stand out in an way. Let's get started now shall we?

I'm going to go ahead and assume based on your post that you actually don't know what those bolded words mean. So let me pull up some definitions for you. These definitions are directly from me googling the word.

Allegation: a claim or assertion that someone has done something illegal or wrong, typically one made without proof.

Accuse: claim that (someone) has done something wrong.

I'm going to give you the benefit of the doubt and assume that you know what a claim means at least. Now correct me if I'm wrong, but I'm pretty sure that Article 11 of the Universal Declaration of Human rights states that everyone has the right to be presumed innocent until they are proven guilty of a crime. The 5th, 6th, and 14th Amendments of the United States Constitution are also all built around presuming the innocence of those accused of a crime. But according to you all it takes for a person to be considered guilty of rape are accusations and allegations. So if I told the police that you took me into the bathroom and touched my willy, would you become a rapist? I mean police would be obligated to bring you in for questioning based on my sole testimony alone. Would they find out that I made it up just because I didn't like that post you made on Wrestlezone Forums? Probably, but does that change the fact that all your neighbors saw you get dragged into a police car?

I'm not saying Winston did it or didn't do it. That isn't my call to make, and I'm certainly to qualified to make that type of call based on a third hand story of what happened. All I know are the facts that are put on the table, and all I see if that they couldn't charge Winston with the rape because they didn't have enough evidence for it. And it now doesn't matter if he did do it or not, because on thing won't change and that's the fact that this story will follow this young man for the rest of his life. He won't get his reputation back.

All it takes is one allegation, which is why I implore my friends to be careful with woman they date. Taking them home on the first couple dates and having sex is a risky slope. Not to get too personal, but I'm someone who would wait a little longer. A fellow detective friend of mine had a case where a woman told police that a date of hers had forced her back to his house, and had raped her. Her story had so many details, and was very believable. Even up to the point where she said her attacker had a gun behind his door, which he did. The police obviously arrested him and took him into questioning, which he was completely thrown off by. He said that he took her home, and they had sex, but it was all with consent, and that she left and took a taxi home. Later the girl finally confessed that she made it up, that she was made because the guy refused to pay for her taxi ride. She actually ended up spending some time in jail because of her false accusations, but that doesn't change the fact that the young college kid got arrested for an accused rape and everyone on campus knew it.

So to reel back more into what you were saying about athletes being above the law...why would Florida State suspend their student based on an accusation of rape when there wasn't even enough evidence for him to be charged of the crime? As far as what you said with the whole "taking illegal money" thing. You do realize that it's not against the laws of the state of Florida to take money in exchange for something like an autograph, or any state actually? Yes it may be against NCAA rules, but it's not against the actually law of the United States, so how could they be above it? I'm sure the NCAA is going to investigate those accusations, and if they find something you know they'll come down hard because they're really strict on that stuff, but that's not athletes being above the law.

As far as the sports broadcast that you watched...it was a sports broadcast. You're mad at them for talking about sports on a sports broadcast??? That's what it is! That are supposed to talk about the upcoming game and that situation. It's not Fox News. They're not going to go that in-depth with the whole situation. They're just telling it how it is, and even then they were probably more so talking about the allegations of the autograph situation. If one of those anchors on that sports broadcast even said in a sentence that they thought that Winston raped that girl, they would be fired on the spot, and sued by Winston for slander. Because that's what slander is. Now they can present the facts and let the watchers make their own assumptions, but that's not what they're going to do on a channel like ESPN or a pre-game show anyway! Again it's not CBS or Fox, it's sports. They're paid to talk about sports, and they'r going to keep it about sports.

I get annoyed to the end when I see them talking about the Ray Rice situation or the Adrian Peterson situation on NFL Network when it doesn't actually regard his status on the team or in the NFL. Or the whole situation with Aaron Hernandez, or Jerry Sandusky. When it goes past the point where they're no longer even talking about football anymore on a channel like NFL Network...it's gone too far for me. If I wanted to hear about that stuff I would watch Channel 11.

But speaking of Ray Rice and Adrian Peterson. I think that kind of shows that athletes aren't above the law. Now well...Rice might be a questionable example, but to touch lightly on that the reason why he isn't sitting in a jail cell is because one he has a lot of money and can afford to hire a really good attorney, and two the jails are already filled with murderers, rapist, and drug dealers, so a lot of people are ending up getting lighter sentences like probation and house arrest to accommodate that. The Peterson situation hasn't finished yet so we don't know what's going to go down with him. And I think it's pretty fair to say Aaron Hernandez isn't above the law.

I will say though I actually agree with you on the hazing. I actually made a thread just a few days ago regarding this over in the Wrestlezone Symposium about an autistic boy who was taped to a goal post in a form of "hazing by his teammates. And in all those comments from the article a lot of people were saying "if he wasn't autistic it would just mild hazing". But like I said in that post, this isn't the 1970s anymore. You can't just go around taping people to goal posts and beating them with wooden paddles. That grounds for some serious charges. I was never hazed, but I can sure as hell tell you if someone did try it. If I was beaten with a wooden paddle, or taped to the goal post...I would make sure they're charged, and then I would probably sue them civilly too if I could. Call me whatever you want but that's what I would do.

I'm not even going to touch the things you said about the police trying to keep it silent, because them I'm going to get even more fired up. Just let me tell you whether this is true or not, the majority of the police force is not corrupt. It's pretty comparable to say the Catholic Church and the priests. There are obviously a lot of good Priests out there, but the few bad ones cast a dark shadow on all the good ones. Same thing goes for police. There are so many great officers out there who far outnumber the bad ones, but the bad ones are all you hear about in the news and the media.
