They passed an act of parliament under urgency last night on File Sharing over the internet. passing a law like that all well and good if there was the full process followed, and not just pushed through under urgency.

And the funny stuff is where an MP compares the Internet to Skynet.

We are in the shitty part of governments in New Zealand in the lead up to the Election this year, where shit loads of crappy bits of legislation come in and get passed under urgency, so its all done in a day or so.

I was reading about this on Slashdot. Didn't the law say something like if you get three strikes based upon copyright CLAIMS (not even proof), then you're disconnected from the Internet for a long time?

Basically, completely ignoring any chance for any citizen to defend themselves from erroneous claims?

yeah, its a stupid piece of legislation and I don't know anyone that supports it.They also have to inform the affected party.

unless you are an absolute idiot you can still get away with it, the problem is that you get accused and you have to prove yourself innocent rather than the normal and correct path of innocent until proven guilt. This is where the problem lies.

There is a statement of there being no such thing as innocence but only degrees of guilt. this is a truth but it is absolutely political death to try and enforce it.

I'm not going to lie, I know absolute dick about NZ law, but in the USA, "innocent until proven guilty" doesn't apply to civil cases. Maybe it works the same way in NZ?

I'm not going to lie, I know absolute dick about NZ law, but in the USA, "innocent until proven guilty" doesn't apply to civil cases. Maybe it works the same way in NZ?

I'm also not sure that copyright infringement and the usage of infringed upon materials is strictly a civil matter either.

It's only a civil suit if the aggrieved party opts to go that route. The act itself, in the U.S., is still pursuant to criminal proceedings. There's just an additional option, as with most cases, for the defendant to seek re-compensatory action upon the individual(s) distributing or illegally obtaining their intellectual property(ies).
